Benefits of Working With an Immigration Lawyer

The U.S. Citizenship and Immigration Service (USCIS) and the National Visa Center (NVC) receive tens of millions of visa applications annually. You often need more than paperwork to obtain permission to enter and stay in the United States lawfully. Many immigration matters require months or even years of preparation and planning.

Working with Pollak Immigration on the following matters, you will realize several benefits:

Visa Applications

When you work with an experienced Dallas immigration lawyer, you have a trusted advisor and representative on your side. Hiring our firm for your visa application provides the following benefits:

  • Over two decades of experience working with the immigration system
  • Detailed knowledge of visa processing and immigration court procedures
  • A wealth of knowledge from prior cases to help you present a persuasive case
  • Passion for helping individuals and businesses reach their immigration goals

When you hire us, we strive to file an accurate and complete application with the best possible supporting documentation so that you get an efficient and timely response from USCIS or NVC. Our services do not end when the visa is issued. We review the restrictions imposed by the visa with you. We also explain the renewal or extension process, if applicable for your visa type.

Compliance

We assist clients with immigration and labor compliance. The U.S. government puts businesses in a difficult position by limiting which visa holders are eligible to work while simultaneously prohibiting discrimination among workers and job applicants. Thus, hiring all immigrant applicants could run afoul of immigration laws, while hiring no immigrant applicants could run afoul of labor laws.

An experienced Dallas immigration attorney can help businesses weave between these government restrictions. We craft compliance plans with specific action items that can help your company implement a hiring and onboarding process that reduces your risk of enforcement action from Immigrations & Customs Enforcement (ICE) or the Department of Labor (DOL).

Immigration Court

Finally, we represent immigrants in immigration court. This forum is used to adjudicate immigration violations that potentially expose the immigrant to deportation and other sanctions, like rendering you ineligible for a future visa.

When you or a family member require representation at an immigration hearing, we listen to your story with compassion and lay out your options for getting a fair outcome based on the circumstances. We will recommend possible strategies and advocate for your rights at your hearing.

Pollak Immigration is dedicated to helping people navigate this process. Our managing attorney has decades of immigration law experience and a passion for helping families, businesses, and investors build their American dreams. Choosing the Right Immigration Attorney

You will find many options when you search for an immigration lawyer. However, your family relationships, career, business, or safety may be at risk in your immigration case. You need a Dallas immigration lawyer who is qualified to handle your case, experienced in immigration laws and procedures, and passionate about helping you.

The first step in finding an immigration attorney is to gather names of lawyers who provide the services you need. Talk to your family members, friends, and co-workers about the lawyers they have used. Use their recommendations for and against the attorneys with whom they have direct experience.

If you do not have anyone who can give you recommendations, you can contact a lawyer referral service certified by the State Bar of Texas. You can also search online for a lawyer, but you should keep in mind that the best lawyer for your case might not necessarily be the one with the biggest advertising budget.

Our managing attorney has over 27 years of legal experience. The firm has a perfect 10.0 Superb rating from Avvo. Since founding the firm, we have successfully represented thousands of clients.

Initial Consultations

Once you gather some names, contact the lawyers for a consultation. If you have not yet entered the United States, immigration lawyers often offer phone or video consultations. If you are in the Dallas-Fort Worth area, you can schedule an in-person consultation.

The consultation is your opportunity to interview the lawyer to determine whether they are a good fit for your case. When making your hiring decision, you should ask questions like the following:

  • What are your legal fees?
  • What other expenses should I expect?
  • How much experience do you have with cases like mine?
  • What do you anticipate the outcome of my case will be?
  • What can I do to improve my chances of success?
  • What are my options if my application is denied?
  • How long will my application take?
  • How often will I receive updates about my application?

As you discuss your case, listen to the lawyer’s answers and assess their communication skills. Communication is a core part of any legal case. The lawyer must explain your legal situation to you, persuade a government official to grant your requests and advocate for your rights in immigration court.

The best lawyer for your case will give clear and well-thought-out answers to your questions. Our managing attorney has represented clients facing many different circumstances. We have guided clients through complex and confusing situations to obtain positive outcomes.

Honest Communication

Lawyers owe you a duty of confidentiality when you speak to them about possible representation. The lawyer risks losing their law license if they use or disclose anything you discuss during your consultation.

The goal of client confidentiality is to encourage a full and honest discussion. During your initial consultation, you should disclose everything relevant to your application, even if it could harm your case. We can only analyze your case thoroughly when we have all the facts. Equally importantly, you could face serious consequences if your visa application contains false or misleading information.

Pollak Immigration has handled hundreds of cases since its founding over seven years ago. We approach your representation with compassion. We understand that no visa applicant is perfect and will analyze your situation objectively and without judgment.

Fees

Most Dallas immigration lawyers use two billing structures. Flat fees are typically charged for cases that involve a known amount of work. Hourly fees are usually charged for cases that require an undefined amount of work or that remain open-ended.

You should discuss fees before hiring a lawyer. You need to know how much to budget for your case and what additional costs you might incur. By understanding the fees early, you will avoid any misunderstandings or surprises.

Hiring a Lawyer

You should hire a lawyer who meets your needs. Specifically, you need a lawyer with the skills, compassion, and experience to handle your case how you want it handled. Moreover, the lawyer should be someone you can work with. Your case could take several months or longer, so you will need a lawyer with whom you can develop a strong professional relationship.

Our firm has over 140 five-star reviews on Google. Our managing attorney has been named a Texas Super Lawyer by Thomson Reuters since 2018. We strive to build relationships with our clients by providing high-quality legal representation to obtain positive outcomes.

Visa and Immigration Applications

Nations use visas to regulate who enters. The exact requirements and limitations imposed on the applicant will depend on the type of visa. Immigration applications are also approved for specific reasons. In either case, filing the wrong application or supporting documentation can result in a denial of entry into the United States.

When you hire Pollak Immigration for your visa or immigration application, our Dallas immigration lawyer will provide the following assistance:

  • Listening to your situation, including your concerns and goals
  • Advising you of your options, including the risks and benefits of each
  • Crafting a legal strategy to reach your goals in a timely and efficient way
  • Working with you to gather documents to support the application
  • Preparing your paperwork with careful attention to detail
  • Consulting with you to ensure the accuracy of your application
  • Filing your application
  • Receiving communications from USCIS or NVC
  • Discussing your options for responding to USCIS or NVC
  • Filing your responses to questions raised about your application
  • After your visa is issued, explaining any restrictions you must follow
  • If your visa is denied, analyzing your options for proceeding

U.S. visas fall into two categories. Immigrant visas are filed when the applicant intends to stay permanently in the United States. Nonimmigrant visas are filed when the applicant has a specific reason for entering the United States and plans to leave the country when the reason ends.

A few visas are considered dual-intent, meaning that the applicant wants to enter the United States as a nonimmigrant and apply for permanent residence while here.

We have experience successfully obtaining the following visa types for our clients:

Business Visas and Green Cards

Workers and employers can use employment-based visas for job-related entry into the United States. Employment-related immigrant visas include:

EB1 Visas

for those of extraordinary ability, educators, and business managers

EB2 Visas

for those of exceptional ability and those holding advanced degrees

EB3 Visas

for skilled workers, professionals, and unskilled workers

Some categories of EB1 and EB2 visas allow self-petition. The remaining categories require employer sponsorship. If you want to come to the United States for a job opportunity, we can help you get the immigration papers you need.

We also assist workers applying for nonimmigrant visas. These visas include the following classes:

E3 Visa

Citizen Through Naturalization

F1 Visa

Student Visa

H1B Visa

Specialty Occupations

L1 Visa

Intra Company Transferees

O1 Visa

Extraordinary Ability

P Visa

Athlete / Entertainer

R1 Visa

Religious Professionals

TN Visa

NAFTA Professional

The United States provides a visa that fits almost every job or profession. However, the qualifications and documentation requirements will differ for each. If you plan to visit or move to the United States to practice your occupation or profession, contact us for a consultation to discuss your options for seeking entry into the country.

Family Visas and Green Cards

Family visas and Green Cards allow relatives to reunite in the United States. They also bring together fiancés. We assist applicants already in the United States or those planning to enter the country from other nations. We also help family members already in the United States who are authorized to file a petition or application for their relatives outside the country.

Our experience with family immigration issues includes the following:

Green Cards

Legal Permanent Residency
Family and Marriage Based Green Cards

Citizenship

Citizen Through Naturalization

K1 Visa

The Fiancé (e) Visa

Family petitions fall into two categories depending on the petitioning family member’s immigration status and relationship. First, the United States grants unlimited visas to immediate relatives of U.S. citizens. These U.S. citizens can petition for the following relatives to enter the country:

  • A spouse
  • Parents
  • Unmarried children under 21, including adopted and step-children

A U.S. citizen can also file a petition for a fiancé to enter the United States. This visa differs from other family visas because it only lasts for 90 days. If the couple marries within 90 days of entry, the U.S. citizen can file a Green Card petition for the visa holder.

Second, the U.S. government grants a limited number of family preference visas. These visas are granted to relatives of U.S. citizens and lawful permanent residents who fall within specific categories.

U.S. citizens can petition for a visa or Green Card for the following relatives:

  • Children over 21
  • Married children of any age
  • Spouses and children of eligible children
  • Children of a spouse
  • Siblings

A U.S. permanent resident or Green Card holder can file an immigrant visa petition for the following relatives:

  • A spouse
  • Unmarried children of any age

If an eligible relative is already in the United States on a valid visa and they want to become a lawful permanent resident, they can apply for an adjustment of status. If granted, the relative will receive a Green Card.

We consider family reunification one of our motivating factors. We will guide you through the application process. Once the visa or Green Card is issued, we will provide guidance on complying with any restrictions and extension deadlines you may face.

Investor Visas

The United States offers both immigrant and nonimmigrant visas to investors and international traders. These visas allow you to come to the United States for investment or trade opportunities. They also allow you to enter the country to monitor your investment.

We have experience obtaining the following investor visas for our clients:

E1 Visas

Treaty Trader Visa

E2 Visas

Treaty Investor Work Visa

EB5 Visa

Investment Visa

The E1 and E2 visas are nonimmigrant visas, while an EB5 visa is an immigrant visa. Thus, an EB5 visa holder can have immigrant intent while E1 and E2 visa holders must intend to return to their countries after completing their work.

Investor visas help you take advantage of U.S. markets and multinational business opportunities. In the process, you may even be able to seek U.S. permanent residence, depending on your goals.

Immigration Court Proceedings

We represent people who enter the country and receive a notice to appear in immigration court. We have extensive experience fighting the U.S. government so you can try to remain in the country.

Visa holders can be called into immigration court to face deportation. A common reason for these notices occurs when a visa holder overstays their visa or violates the restrictions of the visa. For example, certain visa holders are not allowed to work while in the country. You might receive a notice if the government thinks you were employed while visiting on your visa.

In many situations, the government has made a mistake. It might have received incorrect information or mixed you up with someone else. It is important to respond to the government’s allegations to avoid receiving an order to leave the country.
