Immigration Decision Vacated By Attorney General Holder

attorney general eric holderIn a recent matter (Matter of Paul Wilson Dorman, 25 I&N Dec 485, AG, Apr. 26, 2011), Attorney General Holder ordered the BIA to opine on the constitutionality of the Defense Of Marriage Act in a cancellation of removal case. Since same-sex marriage is now recognized in a number of foreign jurisdictions (in addition to several states in the US), this issue could potentially affect a large number of same-sex couples applying for immigration visas
